Read the summons in full
Check the issuing authority, case number, scheduled date and stated procedural role. An informal request and a formal summons may have different implications. Send the whole document rather than a cropped screenshot. If your role is unclear, the lawyer should establish it before advising on the substance of an interview.
A statement as a suspect
The accusation and the relevant procedural rights must be explained under the criminal procedure rules. A suspect’s right not to give an explanation about the allegation is distinct from identity requirements. Legal assistance can help identify questions that require clarification and requests for potentially exculpatory evidence. Do not assume that signing a standard form answers every procedural question.
Review the recorded statement
The record should reflect what was actually said. Read it, or have it interpreted into a language you understand, before signing. If an answer is incomplete or inaccurately recorded, raise the discrepancy and seek its correction. Translation matters particularly where everyday words carry a different legal meaning or a statement distinguishes direct knowledge from assumption.
Prepare a reliable timeline
List dates, places, people and available records. Separate personal observations from information received from others. Bring the summons and relevant documents and tell the lawyer about earlier statements in the same matter. Consistency should come from an accurate account and the evidence; it should not be achieved by inventing facts or filling gaps with guesses.
What to have ready
- Full case number and the authority handling the matter
- Your procedural role and current country of residence
- Original decisions and notification or service records
- A dated timeline and the evidence already available
- Known hearing dates, travel plans and your questions
Common questions
Are witness obligations the same as suspect rights?
No. The applicable duties and any right to refuse testimony depend on the procedural role and statutory circumstances.
Can an English summary replace the interview record?
A summary helps preparation but does not replace the original record or a translation needed for the proceedings.
