Handling a Turkish criminal case from abroad

A person living outside Turkey may still receive summonses or have an ongoing Turkish criminal file. Start with reliable documents and a clear representation plan.

Establish the case position

Send the authority, case number, procedural role and available decisions. After the appropriate appointment and identification, the lawyer can assess available access to the file. Public information and an informal report cannot conclusively establish a personal case status. Explain whether another lawyer has already filed applications or received notices.

Prepare a power of attorney

Depending on the required act, a power of attorney may be arranged through a Turkish consular service or an overseas notarial route with the necessary authentication and translation. The required wording and acceptance should be confirmed before signing. Do not assume that a generic foreign document meets every procedural need.

Attendance and travel

Representation does not automatically excuse a defendant from appearing or lift a warrant or travel restriction. Discuss planned travel and every known summons in advance. Availability of a particular attendance arrangement depends on the law and the case. A legal assessment should be based on current documents rather than an old assurance about the file.

Coordinate across jurisdictions

Turkish proceedings and proceedings in the country of residence may raise different legal questions. Extradition, mutual legal assistance and the effect of a foreign judgment need a separate analysis where relevant. The work should clearly identify what the Turkish mandate covers and when advice from counsel in another jurisdiction is needed.
