TURKISH CRIMINAL LAW · AV. MURAT ADAR

Assault, injury, threats and personal disputes

Personal disputes may produce competing complaints, medical reports and witness accounts. Each alleged act and each person’s procedural role should be assessed separately.

Record each event separately

Identify dates, locations, participants and the sequence of acts. A later argument may be legally distinct from an earlier incident. Separate what you saw from what you were told. If both sides have complained, provide the documents from each file so the relationship between investigations can be understood.

Medical and other evidence

Medical reports, photographs, messages and witness information may help assess an injury or threat allegation. A report’s wording can affect the legal characterisation and should be read in full. Explain when and how evidence was obtained. Missing or conflicting records may require further investigation rather than a conclusion based on one image.

Complaint and protective measures

Whether a complaint is required, which time limits apply and whether protective measures are relevant depend on the alleged act and circumstances. An agreement between the parties does not necessarily terminate every criminal proceeding. Any withdrawal or settlement should be assessed for its legal consequences before it is submitted.

Defence and compensation

The criminal allegation and potential civil compensation have related but distinct requirements. Self defence or other legal issues must be supported by the actual facts and evidence. The lawyer should examine the sequence, proportionality and applicable law without assuming that a label supplied by a party decides the case.
