TURKISH CRIMINAL LAW · AV. MURAT ADAR

Cybercrime, online scams and account misuse

Online incidents can involve several offences and more than one jurisdiction. The first task is to preserve a reliable account of the event and identify the relevant digital records.

Map the incident

List accounts, platforms, dates, payment channels and the people or profiles involved. Distinguish an unauthorised login from an alleged deception, publication or financial transfer. Several acts may be connected, but each allegation needs its own factual basis. Provide original URLs and identifiers where available rather than only the display names of profiles.

Preserve usable records

Keep message exports, transaction references and files with their dates and context. A selected screenshot may support an overview but can omit earlier messages or account details. Explain which records are available and which have been lost. The lawyer can assess requests for data preservation or collection through the appropriate authority.

A cross border element

A foreign platform or bank does not automatically mean that a Turkish complaint is unavailable or that Turkey has jurisdiction over every act. Relevant locations, victims, conduct and statutory rules must be considered. International evidence collection can differ from ordinary domestic requests. Foreign proceedings may need a separate lawyer in that jurisdiction.

Criminal and other remedies

Account restoration, content disputes, recovery of a payment and a criminal complaint may involve different procedures. Explain the result you need, including whether the immediate concern is financial loss, access or published content. The appropriate legal route should address the actual objective rather than treating every online incident as the same offence.

What to have ready

  • Full case number and the authority handling the matter
  • Your procedural role and current country of residence
  • Original decisions and notification or service records
  • A dated timeline and the evidence already available
  • Known hearing dates, travel plans and your questions

Common questions

Are all online disputes criminal offences?

No. The facts may call for criminal, civil or platform based action, sometimes in combination.

Is a profile name enough to identify someone?

It is a lead, not necessarily proof of identity. Additional records may be required.
