TURKISH CRIMINAL LAW · AV. MURAT ADAR

Fraud allegations and financial transactions

Commercial disagreements, online transactions and bank transfers need careful factual analysis before they are characterised as criminal fraud.

Separate the transaction from the allegation

Set out the promise, payment, delivery and communications in chronological order. A failed contract and a deception allegation are not automatically the same. The lawyer must examine the alleged conduct, intention and evidence under the relevant offence provisions. A payment receipt explains a transfer but may not establish the full relationship between the parties.

If you are a complainant

Supply transaction references, recipient details, messages and proof of the claimed loss. Explain what was promised and when the issue became apparent. A well documented complaint can identify investigative leads. Recovery of money remains a separate practical and legal question and may require a civil claim or other action beyond the criminal complaint.

If your account is involved

Explain who controlled the account, why the payment was received and whether money was forwarded. Provide agreements and the complete communications, including information inconsistent with the allegation. Knowledge, participation and the actual flow of funds must be assessed. There is no single defence that applies to every account holder.

Evidence and loss

Keep original records and distinguish verified amounts from estimates. The authority may need bank or platform records beyond what a private person can obtain. Discuss specific requests with the lawyer. A payment after a dispute may have legal significance in some circumstances, but its effect cannot be assumed without analysing the alleged offence and case stage.

What to have ready

  • Full case number and the authority handling the matter
  • Your procedural role and current country of residence
  • Original decisions and notification or service records
  • A dated timeline and the evidence already available
  • Known hearing dates, travel plans and your questions

Common questions

Will a criminal complaint return my money?

A complaint does not guarantee repayment. Separate recovery options should be assessed.

Does lending an account remove responsibility?

Responsibility depends on the conduct and evidence. That explanation must be examined rather than treated as an automatic defence.
